Sub: Surrender of Earned Leave of the employees of Co-operative Societies-Eligibility-instructions issued.

As per Rule 190 (8) of Kerala Co-operative societies Rules “Every employee of a Co-operative Society shall be eligible for different kinds of leave (including surrender of Earned Leave for the purpose of encashment) as in the case of Government employees as prescribed under Kerala Service Rules”. The eligibility of surrender of Earned Leave as allowed to State Government employees upto 1-3-92 as per G.O. 1st to 3rd cited have been enjoyed by the employees of co-operative societies from time to time in the same pattern. The Government while issuing the general pay revision order as per reference 4th cited, have restricted the number of Earned Leave to be surrendered in a financial year to a block of 15 days with effect from 1-3-92. But it is now brought to the notice of the Registrar that some of the societies have allowed the benefit of surrender of Earned Leave over and above limits prescribed, by the Government in the reference cited as 4th paper even after the date of order. Even though there is no relevant provision or rules governing surrender or Earned Leave for the purpose or encashment in Kerala Service Rules, the employees are entitled to the benefits of surrender of Earned Leave as in the case of Government Servants as is specifically provided in Rule 190 (8) of Kerala C-operative Societies Rules 1969. As such, it is hereby ordered that the employees of all Co-operative institutions will be eligible to surrender a block at 15 days (Fifteen days) of Earned Leave in an year. Though, the restriction of surrender of Earned Leave to 15 days was ordered in the case of Government employees with effect from 1-3-92, in order to avoid hardship to employees who may have already availed of this facility, this circular instructions is given effect only from 1-4-95. The leave salary if any claimed in excess of 15 days of surrender of earned leave on or after 1-4-95 will have to be recovered in instalments before the close of financial year 1995-96. Proportionate number of Earned Leave will be credited back to the leave account of respective employees on refund of complete amount of leave salary in excess of admissible limit as per this circular.
Any directions/instructions issued in this regard by Joint Registrars/Assistant Registrars stand superseded by this circular.
The Joint Registrars of the District will bring the contents of this circular to the notice of all societies in the District for strict compliance.

Sub: Co-operatives-primary Housing Co-operative Societies-Fixing of the Maximum rates of travelling allowances, daily allowances and sitting fees to the members of the Board of Directors of the primary Housing Co-operative Societies under rule 48 (5) of the KCS Rules 1969 - Regarding.

The Sub-rule (5) of the rule 41 of the Kerala Co-operative Societies Rules, 1969, empowers the Registrar of Co-op: Societies to fix the maximum rates Of travelling allowances, daily allowances or sitting fees for any Society, or class of Societies. May Primary Housing Co-operative Societies requested to revise the maximum rates of travelling allowances, daily allowances and sitting fees payable to the members of the Board of Directors of the said societies on a par with those rates existing and applicable to the identical Co-operative institutions taking into account the increase in the travelling expenses, rise in the index of the cost of living etc. The Kerala State Co-operative Housing Federation Ltd. also has conveyed its views vide resolution No.6 dated, 21-11-1994. The matter has been examined in detail.
In the circumstances, in modification of the existing circulars instructions in this regard, the following maximum rates of travelling allowances, daily allowances, and sitting fees are fixed for the primary Housing Co-operative Societies by virtue of the powers conferred on the undersigned under sub-rule (5) of the rule 48 of the KCS Rules, 1969.

Sub: Liquidation of Co-operative Societies-Levy of Liquidation charges-Instructions issued.
In exercise of the powers conferred under Sub Rule (7) of Rule 69 of the Kerala Co-operative Societies Rules, 1969, the Registrar of Co-operative Societies, prescribes the following rate of levy of liquidation charges.
(a) The liquidators throughout the State will levy 15% of the total cash collections towards the cost of liquidation.
(b) Out of 15% so collection ¾ (i.e. 11.25%) shall be remitted to Government.
(c) The remaining ¼ (i.e. 3.75%) of the total cash collection left to the liquidators to meet essential contingent charges.
Cash collection means the Assets of the liquidated societies realised by the liquidator during the process of liquidation including deposits/and investments withdrawn. Withdrawals from the savings and current accounts of the societies of deposits made by the liquidators out of collections will not however be treated as cash collections.
The revised rates will come into force with effect from 1-7-1995.

The ratio of share linking at the levels of District Co-op: Banks and Primary Agricultural Credit Societies is not uniform and it varies from District to District. Requests have been received from various co-op: institutions for the revision of ratio of share linking. The matter has been examined in detail in consultation with NABARD and Kerala State Co-operative Bank. The National Bank has advised to take suitable action in the matter under intimation to them. The Kerala State Co-operative Bank has furnished proposal for revision of the share linking ratio as approved by the board of directors of the bank in the meeting held on 21-10-94.
Considering the recommendations of the Kerala State Co-operative Bank and all the aspects in the issue, the following ratio is fixed for share linking at various levels of co-operative agricultural credit institutions.

Primary Agricultural Credit Societies to District Co-op: Banks 1:25

It has come to the notice of Government that the Director Board of a Co-operative Society has taken an important decision involving foreign collaboration without the knowledge of Government, although one of the Director Board member was a Government nominee. If only the Government nominee had brought the agenda item to the notice of Government or the Registrar of Co-operative Societies and sought for advice on the stand to be adopted by him on the issue at the Board meeting, such an embarrassing situation could have been avoided.
In order to avoid such situation in the future, all Government Officers whose nominees in the Board of Directors of various Co-operative institutions are directed to ensure the Government interest sufficiently safeguarded while taking decision in such important matters, which are likely to cause disturbances to Government policies and standing orders. Therefore the Government nominees should take up such agenda items with Government and when the same comes up for discussion at the Board Meeting. If there is delay in getting the Government advice, the item may be got deferred till the Government takes a policy decision thereon.
All Joint Registrars are requested to bring the content of matter to all officers who are now functioning as Government nominee in the board of Directors of Co-operative Institutions.

Sub: Gratuity payable to employees of the Primary Co-operative Societies-clarification-regarding.
Ref: Your Lr.No. 1991/94/M dated 4.11.1994.
I invite your attention to the reference cited and also inform that the Gratuity is to be calculated at the rate of wages last drawn by the employee as on the date of superannuation. If the pay and allowances (DA) have been revised subsequently giving, retrospective effect, the amount of Gratuity payable is to be recalculated on the basis of the revised pay and DA eligible as on the date of retirement and the society is liable to pay the Gratuity arrears out of General funds charging Profit and Loss Account.
It is also informed that if the amount received from L.I.C. is short of that which is liable to be paid by the society as per rule, the deficiency is to be made good from general funds charging Profit and Loss Account of that year as this is statutory obligation of the society.
Even if the bye-laws of a society provides for a lesser amount of gratuity than that provides under payment of Gratuity Act or on same other arrangements like Group Gratuity. Insurance Scheme, the employees concerned are eligible for the amount so received from the insurance authorities towards Gratuity, provided the insurance premium paid by the Society against the employee is in accordance with the calculation of amount which is liable to be paid to at the time of retirement as per the payment of Gratuity Act.

No. 1112/77 in the Kerala Gazette No.50 dated 19th November, 1977 as subsequently amended:-
AMENDMENT
In the said notification in article I, after Note (vi to sub-clause (i) of clause (a), the following Note shall be added, namely:-
“(vii) The registration fee for documents securing agricultural loans through Co-operative Societies and housing loans through Housing Co-operative Societies upto Rs. Two lakhs shall be 1% of the value.”
The notification shall come into force with immediate effect.

ORDER
As per Rule 19 (b) of the Rules for the constitution and Administration of the Kerala State Co-operative Employees Welfare Board, as stand amended as per the G.Os read as second, third and fourth papers above, every employee who has exercised his/her option to come over to the scheme to enjoy the benefits under the rules shall pay a monthly contribution of Rs. 20/- to the Fund from the date on which he joins the scheme. Rule 20 of the said Rules says that every society, all or any of the employees of which have exercised their/his option to come over to the scheme, shall contribute @ 50% of the amount contributed by the employee(s) towards the Fund. The Managing Committee of the Kerala State Co-operative Employees Welfare Board has, in its meeting held on 1-4-1995 as per the Resolution read as fourth paper above has resolved to increase the contribution of the Societies equal to the amount contributed by the employees to the Board, in order to strengthen and improve the financial position of the Board and requested Government to amend Rule 20 accordingly.
2. Government have examined the proposal of the Managing Committee of the Board and they are satisfied that the proposal of the Board is for the betterment of the Co-operative Employees coming under the scheme; and are pleased to issue the following amendment, viz.
AMENDMENT
Existing rule 20 of the Rules for the constitution and Administration of the Kerala State Co-operative Employees Welfare Board shall be substituted by the following:
“Contribution by Management: Every society, all or any of the employees of which have exercised their/ his option to come over the scheme, shall contribute an amount equal to the amount contributed by the employee(s) towards the Fund.”
3. The above amendment will come into force with immediate effect.
