CIRCULAR No. 15/88



Sub:   NATIONAL SAVINGS CERTIFICATES AND INDIRA VIKAS PATRAS-Advances by Primary Agricultural Credit Societies against the security of Instructions-Issued.

Ref:   Govt. letter No. 0365/NSD.B1/88/Fin dated 29-2-88.



The following instructions/guidelines are issued regarding granting of advances by the primary Agricultural Credit Societies against the security of National savings certificates and indira vikas patras.



I.    NATIONAL SAVINGS CERTIFICATES.

(1)     The Primary Agricultural Credit Societies Banks may grant advances against the security of National Savings Certificates subject to normal terms and conditions.

(2)     The sale of certificates of Rs.10/- denomination of National Savings certificates V 1 issue has been discontinued with effect form 1st April 1986.

(3)     For the certificates VI & VII series sold on or after 1st April 1986, premature encashment before 6 years will not be allowed except in the following cases:

          (i)   on the death of the holder or both the holders in case of joint holders

          (ii)  on forfeiture by a pledgee being a Gazetted Govt. officer, when the pledge is in conformity with these rules

          (iii) when ordered by a Court of Law.



(4)     The Societies/Banks may prescribe a margin of 25% on the value of original investment in National savings certificates without taking into account the accrued interest, if any, and grant advances to the extent of 75% of such value.



II.      INDIRA VIKAS PATRAS

(1)     Advances can be granted against Indira Vikas patras at the discretion of the primary Agricultural credit Societies/Banks after considering the Purpose and by charging usual rate of interest.

(2)     The margin to be maintained for loans to be sanctioned against the patras will have to be determined by the Societies/banks depending upon the residual period for which the certificate is to run and other relevant factors.

(3)     Premature encashment of the patras are not allowed and they can be encashed only on maturity.

(4)     Though the Patras can be pledged in favour of the banker no lien can be registered as the certificates are issued without registering the name of the purchaser.

(5)     The patras can be treated as main security also.

(6)     The Societies Banks should take utmost care for the safe custody of Patras since they are freely transferable.

CIRCULAR No. 18/88

Sub:   Co-operation-Inordinate delay in the disposal of Arbitration and Execution references-Instructions Issued.

Section 69 and 70 in respect of settlement of disputes and section 76 in respect of Execution of orders etc., of the Kerala Co-operative Societies Act 1969 and Rule framed there under, are introduced with the specific  intention of averting the likely delay in the disposal of disputes taken by the Civil Courts.

But  the state of affairs prevalent in the area of Arbitration and Execution references by the officers of the Department leave much to be desired.

An attempt to identify the cardinal points to be borne in mind by the Department Officers in the processing of reference has been made as under.

I.       Area of Arbitration:-

1.     Prompt endorsements of references to the Arbitrators by the Joint/Assistant Registrars.

2.     Prompt posting and subsequent adjournments by Arbitrators.

3.     Grant adjournments sparingly only at the same time without denying opportunity to present their cases suitably.

4.     Insistence of the Joint Registrars/Assistant Registrars for the prompt return of the files on which verdict is pronounced.

5.     Vigilance in the exercise of powers under section 70 (2) of with drawing and transferring to same other Arbitrator by the Joint/Assistant Registrar if the Arbitrator to whom the reference was endorsed is incapable.

6.     Resorting to disciplinary proceedings against the delinquent arbitrators.

7.     Detailed periodical inspection of Arbitration Register.

If the above referred cardinal points are kept abreast in the disposal of disputes by the officers of the Department, the delay seen in this area can be eliminated to a substantial extent.



II.      Area of Execution.

The present state of affairs of Execution of Awards is also more or less the same.  In this item of statutory responsibility also, the officers of the Department have to apply meticulous care.  In the execution of awards undesirable approach such as frequent, adjournments without looking into its necessity as in the case of arbitration references are very common.  The officers have to bear in mind, the following important points.

1.     Strict adherence to the time schedule in respect of issue of demand notice,  attachment notice, sale notice etc.

2.     Punctual return of the files of voluntary closure.

3.     Close surveillance by the Joint/Assistant Registrars over the adherence of time schedule by the sale officers.

4.     Exhaustive examination of the Execution Register, periodically by the Controlling officers.

5.     Adopting adequate disciplinary proceedings against lazy and indifferent sale officers.



The economic emancipation of the Co-operatives is the predominant aim of the Department for which the speedy disposal of both Arbitration and Execution reference is imperative.



At present, Reserves amounting to Lakhs of Rupees are seen created in audit of Co-operative Credit institutions in respect of overdue Interest.  This is consequent to the accumulation of arrears of advances.  Had prompt attention been applied by the Department Officers in the disposal of Arbitration and Execution petitions preferred by the Co-operatives for the realisation of the defaulted loans and other dues, the arrears could have been cleared to a great extent.



Instances of even not posting for months old petitions for their first sitting have come to light.  Even by a mere service of summons in the case of Arbitration references and timely issue of demand notices in respect of Execution petitions, effective results are sure to be achieved.  The delay in posting the references lead to heavy accumulation of arrears and consequent loss which has to be guarded against by proper plan of action.

On an analysis, it is seen that the arrear position of credit Co-operatives of the state is alarming.  Complaints from several of such institutions are being received against the inordinate delay in the disposal of both arbitration cases and non/delayed execution of awards.  In order to bring the sorry state of affairs to an end, it is decided to launch a special drive from May 1988 to August 1988 for speedy clearance of long pending cases of both arbitration and execution.

The Additional Registrars in charge of the districts allotted to them shall oversee the progress attained, during their visits of the Districts and ensure that there is proper response and progress in the disposal of Arbitration cases over 5 year and Execution cases over 10 years which are to be closed by 30-6-1988 as decided to in the Joint Registrars’ Conference held on 19-3-1988.

Arbitration, Execution, Liquidation etc., are statutory responsibilities of the Department officers. Every officer has to evince maximum interest in the discharge of his statutory duty. Lakhs of amounts locked up in Arbitration and Execution cases without action will be a disgrace to Department.

Once the Arbitration cases are authorised to the Arbitrators the Joint Registrars are not watching whether the Arbitrators do issue notices posting the case for hearing without keeping it in cold storage and whether cases are disposed of within the time allowed in the authorisation order.  The disposal of arbitration cases should be watched by maintaining a separate Register showing the No. of the cases, date of authorisation, to whom authorised, date of 1st  posting, period allowed for disposal and date of final disposal.  The  Joint Registrar/Asst. Registrar should ensure that 1st posting in every case is invariably done by the Arbitrators within a month from the date of authorisation and there should be regular postings in every case with short intervals only so as to close it within the time limit.

In achieving substantial progress in this field of activity the role to be played by the Joint Registrars is highly vital. They have to strain every nerve to improve the state of affairs. The Joint Registrar should make periodical if not monthly review of the progress of disposal of arbitration and execution cases making it a practice to verify files/registers in person and send a copy of the same to Registrar so as to reach this office by the 10th of the succeeding month.

Special attention should be bestowed by the Joint/Assistant Registrars  to examine the old arbitration and execution files and give necessary directions for quick disposal of files. 

Definite targets for closure of old and long pending cases should be fixed and followed up.

Registrar of Co-operative Societies, expects that the Joint/Assistant Registrars should find methods to involve himself and should resort to prompt statutory action against the slack officials.



Registrar hopefully looks forward that with the co-operation and concerted effort of all concerned, the arrears of work under Arbitration and Execution can be eradicated at the earliest.



Deputy Registrar (Audit) in the Office of the Registrar of Co-operative Societies will be responsible for proper Co-ordination of the special drive and put up periodical reports showing the progress for the perusal of Registrar of Co-operative Societies.

Sub:   Opening of branches of Primary Co-operative Agricultural Development Banks-Norms regarding-Instructions issued.

Ref:   NABARD’s letter No. Plan 11277/PL/150/87-88 dated 25-3-88.



As per the reference cited, NABARD have conveyed certain norms for  opening of new branches of the existing Primary Co-operative Agricultural Development Bank.  Based on the same also, the following instructions are issued in this regard.



2.       The basic requirement is that the proposed branch and the parent bank after opening the  new branch, should be potentially  viable.  A loan business measured in terms of loans outstanding of about Rs. 80-100 lakhs for a particular unit is considered to make a branch potentially viable.  Even if the proposed branch and the parent bank after opening of the new branch, are likely to achieve this level of business within the next 2-3 years and are likely to sustain the same, the unit will be considered as viable.



3.       Another criteria to be considered for opening of new branches is that the parent bank should be earning profit for the last 3 years and the proposed unit is also likely to earn profit within the next 2-3 years.  However, special consideration will be given to the proposed branch, if the area is predominantly of tribal population.



4.       The Primary Co-operative Agricultural Development Bank which seeks permission to open new branch should satisfy the following conditions also.

(a)     There should be provision in the bye-laws of the bank to open branches.

(b)     The proposed branch should be strictly within the area of operation of the bank.

(c)     The overdue position of the bank should be reasonably low and should not exceed 25%.  Details of the over due position of the 3 previous co-operative years should accompany the proposal.

(d)     The bank should not have any overlapping of area of operation with any other Primary Co-operative Agricultural Development Bank.

(e)     The bank should have attained a reasonable level of loan business and managerial efficiency at the time of submitting application for a new branch.

(f)      The financial position and general working of the bank should be satisfactory and audit completed up to the previous year.

(g)     The bank should have adopted the model bye-laws prescribed by Registrar of Co-operative societies.

(h)     The new branch shall be run by development of the existing staff of the bank.  A resolution of the Board agreeing  to the above condition has also to be forwarded along with the proposal.



5.       Before forwarding the proposal to this office the Joint Registrars shall along with a senior officer of the Kerala Co-operative Agricultural Development Bank conduct a joint and detailed study and assess the necessity for the branch in the area and the potential and the prospects for enrolling new members, scope for lending for productive purposes etc. after study, they should be convinced of the potentiality of the area of the proposed branch and ascertain whether the branch can become self supporting and attain viability within a period of 2 to 3 years.  The Joint Registrars and Officer of Kerala State Co-op: Agricultural Development Bank will also ensure that in the area where the new branch is proposed to be opened there is no prospect for registering a new Primary Co-operative Agricultural Development Bank in the near future.  Notes on the working of the branch, sketch map showing headquarters of the proposed branch etc. should also accompany the joint study report.



6.       The Joint Registrars are instructed that, while forwarding the proposals recommending sanction to open branches they should make sure that the Primary Co-operative Agrl. Development Bank has satisfied all the above conditions, and that there is ample scope for the successful working of the proposed branch. They will also ensure that all the enclosures mentioned below are scrutinised and forwarded to this office along with the proposal.  There specific remarks on the proposal should also be communicated in the covering letter addressed to this office.



7.       The following proformas duly filled up (Existing) should also accompany the proposal.

a)       Proforma No.I (Details regarding the proposed branch)

b)      Proforma No.II (Particulars relating to the loaning business of the primary co-op: agricultural development bank and the proposed branch) for the last 3 years and next 3 years proposed)

c)       Proforma No.III (Details of probable establishment charges as per the existing staff pattern for the proposed branch)

d)      Other enclosures:-

          1.       Copy of the Registered bye-laws of the bank.

          2.       Project report of the proposed branch prepared by the Bank.

          3.       Joint Survey report of the proposed branch (after conducting the study of the Joint Registrar and the Senior Officer of the Kerala State Co-op: Agricultural Development Bank)

The mode of investment of Reserve Fund  of the Co-operative Societies is prescribed in Rule 60 (1) of the K.C.S. Rules framed under K.C.S. Act 21 of 1969.



It has come to notice that there is no uniformity in the terms and conditions under which the Kerala State Co-operative Bank and District Co-operative Banks accepting Reserve Fund of the affiliated Societies.  It is seen that some District Co-operative Banks accept such deposits as Fixed Deposit while others treat such deposits differently.  The rate of interest offered by the banks therefore differs.  There is no uniformity in the payment of interest on such deposits.  The procedure adopted will have to be in consonance with the object of investing the Reserve Fund separately.  Therefore a procedure to be adopted by the banks on investing the Reserve Fund and the maintenance of such accounts have been suggested by this office and the District Co-op: Banks and Kerala State Co-operative Bank were also requested to offer their comments.  On reviewing the procedure adopted by each bank the issue  was placed in the Central Banks meeting held on 3-3-1988, for consideration.  The procedure suggested by this office has been noted and the opinion expressed was that the same will be considered.



In the light of the above the following procedure is suggested for the acceptance of Reserve Fund of the affiliated Co-operative Societies.



1.       A separate account styled as “Reserve Fund Deposit” of affiliated Societies/Bank will be opened in the name of each society to facilitate easy identification of the Reserve Fund deposit as distinct from other deposits.

2.       The banks will issue a pass book to each Society/Bank for such deposits.

3.       The rate of interest on such deposits should be the maximum rate allowed for long term deposits as fixed by the Reserve Bank of India from time to time.

4.       The interest on such deposits will be calculated at half yearly rests and credited to the Reserve Fund deposits accounts of the concerned Societies/Banks.  Under no circumstances the interest on such deposits shall be paid to the societies/banks or adjusted towards any of the societies/banks.

In this Office circular cited (1) above instructions have been issued for disbursement of IRDP loans by Co-operatives upto Rs.5,000/- on the security of assets created out of the loans and without insisting on personal surety.  NABARD in their circular letter second cited has suggested that for investment loans upto Rs.10,000/- granted under IRDP for all agriculture and other activities, the assets created only be charged as security.

Further in this regard the Reserve Bank of India in their reference No. RPCD.No. SPBC-91/C/568 (P) 86-87 dated 26-3-87 had decided to exempt IRDP loans upto an amount of Rs. 10,000/- from the provisions of collateral security/third party guarantee and the Government of India, Department of Rural Development, Ministry of Agriculture in their Letter No. I-12011/24/85/C&P/IRD-3/-Credit dated 20-7-87 have advised the State Government to implement the decision.

In the circumstances, the limit of IRDP loans issued through Co-operatives without requiring collateral security/third party guarantee is enhanced to Rs. 10,000/- in partial modification of the circular No.40/87 dated. 6-9-87 (cited (I) above).

The instructions contained in the above circular regarding the applicability of norms for the two doses of IRDP assistance will continue. That is the two doses of I.R.D.P. assistance need not be combined for the purpose of applicability of security norms if,

a.       The loanee is a different member of the family i.e. not the same as the borrower for the first dose of assistance or

b.       The activity to be assisted under the supplementary dose is different, even if the assistance is to the same beneficiary.



The Kerala State Co-op. Bank and the District Co-op: Banks are requested to follow the above.
