Sub: Financing of SRTO and NFS loans on personal securities valuation of hypotheca-clarification issued
Ref: Circular No. 89/80 dated 30-12-1980.
As per the circular cited, detailed instructions have been issued with regard to the procedure to be followed for the disbursement of long term loans including the valuation of security properties. Now a doubt has been raised with regard to the valuation of loan applications where an applicant has offered security of hypothecation of vehicles as well as personal security of landed property. It is therefore found necessary to clarify the doubt.
The Primary Co-op: Agricultural Development Banks shall issue loans only on the basis of valuation as per the procedure approved by Registrar of Co-op: Societies. In this office Circular No. 89/80 dated, 31-12-80 the procedure to be followed for the issue of loans by Primary /Co-op: Agricultural and Rural Development Banks have been prescribed. According to the circular the responsibility for valuation of loan application have been fixed as follows.
1. Senior Supervisor of Primary Co-op: Agriculture and Rural Development Banks
2. Agricultural Officers of Primary Coop: Agricultural and Rural Development Banks
3. Asst.Registrar/Valuation Officers.
The intension of the circular is the valuation of the loan application shall also be made by the concerned officers subject to the above limits apart from the valuation of the hypotheca. Valuation of loan application would also mean assessment and certification of the repaying capacity of the borrower with reference to the income that would be generated out of the scheme are income from other funds and worth of the security. Therefore the loan application irrespective of whether the loans are issued on the security of landed properties or not have to be valued with reference to the repaying capacity of the borrower members, by the officers concerned.

Sub: Kerala Co-operative Societies Act, 1969 - powers by Chairman/Chief Executive-clarifications-Regarding.
Subject to the provisions of the Kerala Co-operative Societies Act the Rules made thereunder, and the bye-laws the final authority of a Co-operative Society shall vest in the General Body of its members. The General Body of a society has to constitute a committee in accordance with the bye-laws and entrust the Management of the affairs of the Society to such Committee. The Committee has to function in accordance with the provisions of Kerala Co-operative Societies Act, the Rules and Bye-laws. The Bye-laws of Co-operative Institutions provide for appointment of a Chief Executive (Secretary/Managing Director/General Manger). The powers and duties of the Chief Executive are specifically prescribed by the Bye-laws. As per the Bye-laws the powers of the Chairman/President of the Committee are limited to the overall control of the institution, and presiding over the meetings. The powers of the President/Chairman for the overall control do not include interference with the day to day functions of the institution or the functions which are specifically entrusted to the Chief Executive by the Bye-laws. The duties that are specifically entrusted to the Chief Executive have to be performed only by him. The Chairman/President is only to ensure that the policy decisions taken by the Committee are properly executed or implemented by the Chief Executive.
However, it has come to the notice of the undersigned that in certain Co-operative Institutions the Chairman / President interferes with the day to day affairs of the institution and performs himself the duties that are specifically entrusted to the Chief Executive. Such action on the part of the Chairman/President is improper and violative of the provisions of Bye-laws of the society. If any failure on the part of the Chief Executive in the discharge of his duties is noticed by the President/Chairman he can bring it to the notice of the Committee for taking appropriate action. He may also direct the Chief Executive to keep in abeyance further action in any matter, if he is satisfied that such further action will be contrary to the provisions of law or against the better interests of the society. In such cases the matter should be brought to the notice of the committee at the earliest for its consideration and decisions, However the Chairman/President shall not arrogate to himself the powers which are entrusted to the Chief Executive as per the bye-laws. It is however made clear that the foregoing clarification is not intended to take away any of the powers specifically conferred on President/Chairman by the KCS Rules or the Bye-law of the society.

Sub: Department of Co-operation-Retirement of Share Capital Contribution (under direct participation) by Co-operatives-collection of arrears-instructions issued.
(1) The State Government is providing substantial financial assistance by way of Share Capital Contribution under various schemes to Co-operatives under direct participation. So also financial assistance are being provided by ‘NABARD’ through State Government towards Share Capital Contribution from National Rural Credit (L.T.O.) fund under indirect participation to credit Co-operatives/Banks such as Kerala State Co-operative Bank, Kerala State Co-operative Agricultural and Rural Development Bank, District Co-operative Banks, Primary Co-operative Agricultural Development Banks, Urban Banks, and Primary Agricultural Credit Societies.
(2) The financial assistance given towards Share Capital Contribution under ‘Direct participation’ is repayable to Government by Co-operatives in instalments fixed in the relevant Rules approved by Government. For the belated repayment of the instalments the societies are liable to pay penal interest also at the rate of 2 ½ Percent. The terms and conditions for retirement of Share Capital Contribution to Co-op: Societies/Banks under “Indirect Share participation” will be prescribed by Government in consultation with the NABARD and separate orders will be issued shortly.
(3) During Finance Inspection of the Offices of Joint Registrar in the districts it has been found that action initiated by Joint Registrar for the collection of arrears of amount due to Government in this regard is very poor. Some of the officers are under the impression that the Share Capital Contribution given by Government to various Co-operatives under “Direct participation” also need not be retired as in the case of assistance given under “Indirect Participation” to Primary Agricultural Credit Societies. Moreover, it is also noticed that the question of collection of arrears in this regard is not even discussed in the monthly conference of Asst. Registrars (General) in the district held by Joint Registrars. As on 1-12-1993 an amount of Rs. 523.88 lakhs is due to Government towards due instalment of Share Capital under Direct participation from various Co-operative Societies in the District except that due from Apex Institutions.

Extracts of the relevant rules for payment of Share Capital Contribution to various Co-operatives under direct share participation by Government are enclosed for ready reference (Annexure).
(4) Therefore, the Joint Registrars are once again requested to see that the progress in retirement of Share Capital Contribution to Government by various Co-operatives in the District under “Direct Participation” should be reviewed in the monthly conference of Assistant Registrars (General) regularly and monthly target fixed for each circle for collection of arrears and vigorous action should be taken to collect the arrears due to Government in this regard.
(5) A large number of Societies to whom the Share Capital Contribution under ‘Direct Participation’ have been given are now financially sound and are capable of retiring the share due to Government. The laxity on the part of the field officers of the department has mainly contributed to the non-realisation of share due to Government and this state of affairs can no longer be allowed to continue when the State Government is facing financial strain.

1. Integrated Co-operative Development Project:

Rule 9 (a) –“The Share Capital Contribution sanctioned under various schemes under the Integrated Co-operative Development Project will be retired in 14 annual instalments 1st instalment falling due on the first anniversary of the drawal of the amount from the Treasury”.
2. Share Capital Contribution in the Kerala State Co-operative Housing Federation:

Rule 9 “The Society shall repay the Government the value of the shares allotted by the Government in ten annual equal instalments commencing from the sixth year of the disbursement of the assistance to the society”.
3. Share Capital Contribution to Kerala Government Secretariat Staff Housing Society Ltd.:

4. Share Capital Contribution to Primary Housing Co-operatives:

11. NCDC Schemes Share Capital Contribution to Primary Marketing Co-operative Societies under the scheme of rehabilitation of Marketing Societies.

In para 2 (4) of the Circular first cited the Senior Supervisor of the Primary Land Mortgage Banks have been authorised to value security properties in respect of loan application upto and including Rs. 10,000/- and the Agricultural Officers working in the Banks have been authorised to value loan Application upto the including Rs. 20,000 and in all other cases by Valuation Officers.
As per circular second cited Junior Supervisors of the Primary Co-operative Agricultural Development Banks, where there are no senior supervisors, having experience of 3 years have also been authorised to value security properties in respect of loan applications upto and including Rs. 10,000/-
As per circular third cited the above ceiling was partly modified and the Agricultural Officers working in Primary Co-operative Agricultural Development Banks have been authorised to value loan applications upto and including Rs. 30,000/-
As per the letter fourth cited Kerala State Co-operative Agricultural and Rural Development Bank has requested to change the above ceiling. This has been considered and para 2 (4) of the circular first cited is partially modified as follows:
2 (4) Valuation:
The Supervisors of the Primary Co-op: Agricultural and Rural Development Banks are authorised to value security properties in respect of loan application upto and including Rs 20,000/- The Agricultural officers working in the Banks are authorised to value security properties in respect of loan application upto and including Rs.30,000/- In all other cases the Asst. Registrar/Valuation Officers of the Co-operative Department are authorised to value the security properties.
However in the case of Primary Co-op: Agricultural and Rural Development Banks where there are no sanctioned post of Asst. Registrar/Valuation Officers and Agricultural officers working in the Banks are authorised to value security properties in respect of loan application upto and including Rs. 50,000/- as a special case till the post of Assistant Registrar/Valuation Officers are sanctioned in these Banks. In all other cases of loan applications in such Banks the officers of the Department who are entrusted with the work are authorised to value the security properties.
This modification will have effect from the date of this circular.

ORDER
As per the Government Order read as second paper above, the classification norms and staff pattern of Primary Agricultural Credit Societies as prescribed in appendix III to Rule 182 of the Kerala Co-operative Service Rules have been revised. As per the revised staff pattern new posts stand allowed to various classes of societies as follows:-
Class I (Spl. Grade)
Class I Internal Auditor
Class II
Class III Internal Auditor, Assistant Secretary and Peon
Class IV Peon
Class V Peon
2. The Registrar of Co-operative Societies has now requested Government to modify the Pay Revision Order issued in the G.O. read as first paper above in order to fix the status and scale of pay in these newly created posts as proposed below:
i) The status of the post of Internal Auditor be above that of Accountant and equal to that of Branch Manager. The scale of pay of Branch Manager in each class of societies be allowed to the Internal Auditor of the respective Class.
ii). The post of Assistant Secretary in Class III Primary Agricultural Credit Societies will be fitted below the post of Secretary and above that of Branch Manager and allowed in intermediary scale of pay viz. Rs.1310-35/4-1450-40/5-1650-45/5-1875-50/5- 2125-60/1-2185.
iii) The post of peon newly introduced for class III, IV and V Societies will carry the scale of pay of Rs. 825-1275.
iv) The scale of pay of the existing posts of Attender in class III and IV Societies may be revised to Rs. 855-1310 in order to distinguish the post as one above that of peon.
3. Government are pleased to accept the above proposal of the Registrar of Co-operative Societies and the order accordingly. The Pay Revision Orders issued in the G.O. read as 1st paper above will stand modified to the above extent.
